All software source code, dashboards, visual designs, written content (including reports, briefs, concept notes, and explanatory text), graphics, photography, and aggregated data products published on tower-watch.com, solmod.systems, and the ProposalFoundry preview are protected by United States copyright law and applicable international treaties. Unauthorized reproduction, distribution, derivative-work creation, or public display, in whole or in part, is prohibited.
The marks TowerWatch, SolMod, SolMod Systems, ProposalFoundry, the cow-with-headphones TherMOOstat mark used in third-party reports, the SolMod louver-and-sun device, and the ProposalFoundry anvil device are claimed as common-law trademarks of David MacDonald and the respective product entities. Use of these marks for identification, comparison, news reporting, or genuine commentary is permitted under fair-use doctrine. Use suggesting endorsement, partnership, or origin where none exists is prohibited.
Third-party trademarks appearing on the sites (e.g., UC Davis, Apple, AVEVA PI, ArcGIS, Cloudflare, Azure, GitHub, OpenAI, Anthropic) belong to their respective owners and are referenced only for accurate description of underlying technologies, data sources, or factual context.

Software pipelines underlying TowerWatch (anomaly detection, demand-charge dispatch optimization, multi-source feed fusion) and ProposalFoundry (three-way faculty/opportunity scoring, brief-generation methodology) embody trade secrets and proprietary know-how protected under California Civil Code §§ 3426 et seq. and analogous law.
Permitted. Browsing the public pages, viewing public dashboards, downloading expressly-published artifacts (e.g., reports linked from the homepages), and quoting brief excerpts with attribution for academic, journalistic, or educational purposes.

Faculty-specific briefs are tailored to the named individual and are not transferable.
The sites use minimal, privacy-respecting analytics (Cloudflare Web Analytics where enabled) that do not set tracking cookies, do not fingerprint users, and do not share data with third-party advertising networks. No personally identifying information is collected from public-page visitors. Server-side request logs (timestamps, anonymized IP, requested URL, referrer, user-agent) are retained for a limited period for operational, security, and aggregate-traffic purposes only.
The /pf-preview/ workspace is gated by HTTP-basic authentication (or, prospectively, Cloudflare Access with email-OTP). Authentication events are logged.
Inquiry messages sent via the published email address are retained as ordinary correspondence. We do not sell, lease, or rent contact information.
TowerWatch dashboards, SolMod published performance figures, and any data, projections, or recommendations on these sites are provided on an “as is” basis, without warranty of any kind — express, implied, or statutory — including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Public dashboards may display delayed, cached, smoothed, or interpolated data and must not be relied upon as official institutional records, financial reporting, regulatory submissions, or life-safety information.
To the maximum extent permitted by law, neither David MacDonald nor any of the foregoing product entities shall be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising from or relating to use of the sites or their content, even if advised of the possibility of such damages.
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions. Any dispute arising from or relating to these terms or use of the sites shall be brought exclusively in the state or federal courts located in Yolo County or Sacramento County, California, and the parties consent to personal jurisdiction therein.
If any provision of these terms is held unenforceable, the remaining provisions shall remain in full force. These terms may be revised; the “Last updated” date above will be amended accordingly. Continued use of the sites after a revision constitutes acceptance of the revised terms.
