Scope. This page governs your use of tower-watch.com, solmod.systems, and the ProposalFoundry private-preview workspace, and asserts intellectual-property rights covering the underlying software, designs, methodologies, and content. The three products are distinct ventures under common ownership; rights are reserved separately for each.

Campus intelligence platform — dashboards, anomaly detection, building telemetry analytics, real-time emergency feeds.
SolMod Systems
Comfort-first exterior solar-louver retrofit technology and the associated measurement, deployment, and pilot methodology.
ProposalFoundry
Funding-opportunity matching, faculty profiling, and proposal-drafting pipeline for academic research.

All software source code, dashboards, visual designs, written content (including reports, briefs, concept notes, and explanatory text), graphics, photography, and aggregated data products published on tower-watch.com, solmod.systems, and the ProposalFoundry preview are protected by United States copyright law and applicable international treaties. Unauthorized reproduction, distribution, derivative-work creation, or public display, in whole or in part, is prohibited.

2. Trademarks & Branding

The marks TowerWatch, SolMod, SolMod Systems, ProposalFoundry, the cow-with-headphones TherMOOstat mark used in third-party reports, the SolMod louver-and-sun device, and the ProposalFoundry anvil device are claimed as common-law trademarks of David MacDonald and the respective product entities. Use of these marks for identification, comparison, news reporting, or genuine commentary is permitted under fair-use doctrine. Use suggesting endorsement, partnership, or origin where none exists is prohibited.

Third-party trademarks appearing on the sites (e.g., UC Davis, Apple, AVEVA PI, ArcGIS, Cloudflare, Azure, GitHub, OpenAI, Anthropic) belong to their respective owners and are referenced only for accurate description of underlying technologies, data sources, or factual context.

3. Patent Notice

Patent applications pending. The SolMod louver assembly — including its retrofit mounting system, integrated photovoltaic surfaces, and ventilation-control geometry — together with related installation, monitoring, and pilot methodologies, are the subject of one or more pending patent applications. No license, express or implied, to any pending or future patent is granted by virtue of access to solmod.systems or its written materials. Reverse-engineering, disassembly, or replication of the louver system or its mounting hardware for purposes other than authorized pilot deployment is prohibited.

Software pipelines underlying TowerWatch (anomaly detection, demand-charge dispatch optimization, multi-source feed fusion) and ProposalFoundry (three-way faculty/opportunity scoring, brief-generation methodology) embody trade secrets and proprietary know-how protected under California Civil Code §§ 3426 et seq. and analogous law.

4. Permitted & Prohibited Use

Permitted. Browsing the public pages, viewing public dashboards, downloading expressly-published artifacts (e.g., reports linked from the homepages), and quoting brief excerpts with attribution for academic, journalistic, or educational purposes.

5. Confidentiality — Private Previews and Faculty Materials

Where a recipient has been granted access to the ProposalFoundry private preview (/pf-preview/), the briefs, opportunity matches, draft applications, and faculty-profile artifacts therein are confidential and provided solely for the recipient’s evaluation. They are not to be forwarded, reproduced, or referenced in onward proposals, peer review, or institutional communications without the originator’s written consent. Faculty-specific briefs are tailored to the named individual and are not transferable.

6. Privacy & Analytics

The sites use minimal, privacy-respecting analytics (Cloudflare Web Analytics where enabled) that do not set tracking cookies, do not fingerprint users, and do not share data with third-party advertising networks. No personally identifying information is collected from public-page visitors. Server-side request logs (timestamps, anonymized IP, requested URL, referrer, user-agent) are retained for a limited period for operational, security, and aggregate-traffic purposes only.

The /pf-preview/ workspace is gated by HTTP-basic authentication (or, prospectively, Cloudflare Access with email-OTP). Authentication events are logged.

Inquiry messages sent via the published email address are retained as ordinary correspondence. We do not sell, lease, or rent contact information.

7. No Warranty — Public Dashboards Are Not Operational Records

TowerWatch dashboards, SolMod published performance figures, and any data, projections, or recommendations on these sites are provided on an “as is” basis, without warranty of any kind — express, implied, or statutory — including merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Public dashboards may display delayed, cached, smoothed, or interpolated data and must not be relied upon as official institutional records, financial reporting, regulatory submissions, or life-safety information.

8. Limitation of Liability

To the maximum extent permitted by law, neither David MacDonald nor any of the foregoing product entities shall be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising from or relating to use of the sites or their content, even if advised of the possibility of such damages.

9. Governing Law & Forum

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions. Any dispute arising from or relating to these terms or use of the sites shall be brought exclusively in the state or federal courts located in Yolo County or Sacramento County, California, and the parties consent to personal jurisdiction therein.

10. Severability & Updates

If any provision of these terms is held unenforceable, the remaining provisions shall remain in full force. These terms may be revised; the “Last updated” date above will be amended accordingly. Continued use of the sites after a revision constitutes acceptance of the revised terms.
